Unveiling of a Controversial Tender in Bandar Imam Petrochemical

A brief look at the transportation tender for Bandar Imam Petrochemical employees in the year 1404 shows that Fanavaran Ghaem Mahshahr Company was excluded from the evaluation stage with a bid of 203 billion tomans, and the contract was awarded to Talal Bandar Company for about 225 billion tomans! This issue has been contested by Fanavaran Ghaem Company, which believes its execution records were ignored during the evaluation process, and its official protest remained unanswered before the contract was announced. The case has now reached the five-member committee for review.

A collection of tender documents and related protest documents from a contractor has raised serious questions about the decision-making process in one of the contracts of Bandar Imam Petrochemical in Mahshahr, a major company in Iran's petrochemical industry with significant financial turnover in its contracting agreements. 

The issue pertains to the transportation services tender for employees in the year 1404. According to the documents provided, Fanavaran Ghaem Mahshahr Company proposed about 203 billion tomans for a one-year contract.

Despite this proposal, the company was excluded from the technical evaluation stage before the winner was determined, and the contract was ultimately awarded to Talal Bandar Company for about 225 billion tomans, a difference of about 22 billion tomans from the eliminated company's proposal. This price difference needs to be explained by the technical evaluation as to why it occurred, and the main issue is how the cheaper company was eliminated and the documents that formed the basis of that decision.

 

Elimination of Records; The Starting Point of Dispute

Documents from Fanavaran Ghaem Company show that this contractor had prior related activity experience in Bandar Imam Petrochemical before the tender, yet why these records were not considered during the proposal evaluation, which played a role in its elimination from the technical stage.

In the official complaint, the performance of the head of contract affairs and the head of the technical-commercial committee of Bandar Imam Petrochemical in this process has been contested, which, if the original documents before and after the evaluation are compared, this part of the case can determine whether the company's elimination was the result of normal execution of tender regulations or an intervention outside those regulations occurred.


Written Protest Before Contract Announcement

The case shows that Fanavaran Ghaem protested its elimination on the day of the envelope opening and officially requested from the management of Bandar Imam Petrochemical to announce the reasons and documents for this decision. This protest remained unanswered for 25 days, and during this period, the contract was announced to the winning company. This timeline is one of the most important parts of the case.

 

Handling the Complaint at the Point of Contention

The dispute entered the review stage after the contract was announced. According to the case, commercial and financial experts initially reviewed the issue, and it is said that the initial expert opinion was in favor of Fanavaran Ghaem Company. Subsequently, Bandar Imam Petrochemical objected to this result, and the case was referred to a three-member committee.

One of the most sensitive parts of the case pertains to how this meeting was formed. According to the written complaint, the meeting was held in the office of a manager whose performance was itself part of the subject of Fanavaran Ghaem Company's protest. The protesting company considers this situation a conflict of interest and contrary to the principle of impartiality in the reviewUltimately, the three-member committee rejected the company's protest, and Fanavaran Ghaem also objected to the review process, requesting the case to be referred to a five-member committee.

 

History of Disputes Over Contractors

These records indeed prove the misconduct in the 1404 tender and show that the contractor activities in this complex are not a new issue. The current case is raised in a situation where Iran's petrochemical industry has previously witnessed major corruption cases and financial misconduct. The famous case of the Petrochemical Commercial Company with a financial turnover of several billion euros is one of the most significant examples.


Questions That Still Need Answers

The 1404 tender documents now pose several specific questions to the management of Bandar Imam Petrochemical and its upstream organization: Why were Fanavaran Ghaem Company's records not accepted in the evaluation? What was the legal basis for eliminating this company? Why was its written protest not answered before the contract was announced? On what technical or contractual advantage was the approximately 22 billion tomans difference between the two proposals justified? And why was the complaint review meeting held at a location that the protesting company considers a violation of impartiality?

Along with answers to these questions, these documents should also be made available to the public for publication: minutes of the technical-commercial committee, the score table of participants, the original financial proposals, submitted technical records, the protest letter and management's response, the initial expert opinion, and the decisions of the review committees.

In a case where the financial dispute amounts to tens of billions of tomans, silence cannot replace the publication of documents. It needs to be clarified whether the tender was conducted based on technical regulations or if the rights of one of the participants were violated during it.
